Photom8 Terms of Service

These terms apply to Photom8 platform use. Tenant businesses may publish additional terms for their own photography services, shoots, events, fulfilment and refund policies.

1. Agreement

These Terms of Service govern access to and use of Photom8, a multi-tenant photography workflow platform operated by Boshoff Technology Service Solutions Pty Ltd. By creating an account, subscribing to a plan, using a tenant workspace, or accessing a client gallery, you agree to these terms.

If you use Photom8 on behalf of a photography business, school, event organiser, studio or other organisation, you confirm that you are authorised to accept these terms for that organisation.

2. Platform Services

Photom8 provides tools for tenant websites, bookings, event galleries, client access, proofing, ordering, payment workflow support, invoicing, notifications, storage, Google integrations, courier or print-lab workflows, and support communication.

Some features depend on third-party providers such as payment gateways, WhatsApp, email, SMS, Google, couriers, print labs or hosting infrastructure. Those providers may apply their own terms, fees, limits and availability rules.

3. Tenant Responsibilities

Tenants are responsible for the accuracy, legality and permissions relating to the content, photographs, client information, event data, pricing, product descriptions, delivery details and communications they upload or manage in Photom8.

Tenants must ensure they have the necessary authority, consent or lawful basis to collect and process personal information, including participant, parent, learner, player, customer or event data.

4. User Accounts and Access

Users must keep login credentials, invite links, event access codes and gallery links secure. Account access may be suspended where there is suspected misuse, unauthorised access, security risk, non-payment or breach of these terms.

Administrators are responsible for assigning appropriate roles to staff, photographers, assistants and client users in their tenant workspace.

5. Payments, Plans and Fees

Subscription fees, setup fees, usage-based charges, storage charges, add-ons and integration assistance fees are billed according to the selected plan or agreed commercial terms. Prices may exclude third-party provider charges unless stated otherwise.

Payment gateway, WhatsApp, SMS, SMTP, courier, print lab, domain, Google Workspace and other external provider fees are billed separately by the relevant provider unless agreed in writing.

6. Content and Intellectual Property

Tenants and their photographers retain ownership of their photographs, branding and uploaded content. Photom8 receives the limited rights needed to host, process, display, secure, deliver and support that content through the platform.

Photom8, its software, workflow design, user interface, documentation and platform assets remain the intellectual property of Boshoff Technology Service Solutions Pty Ltd or its licensors.

7. Acceptable Use

Users may not use Photom8 to upload unlawful content, violate privacy rights, infringe intellectual property, bypass access controls, interfere with platform security, send abusive communications, or use the service in a way that harms other tenants or end users.

Bulk imports, integrations and automation must be used responsibly and within the limits of applicable laws, provider policies and platform capacity.

8. Privacy and Data Protection

Photom8 processes personal information as described in the Photom8 Privacy Policy. Tenants may also need their own privacy notices for their specific photography, school, sport or event workflows.

Where a tenant determines the purpose and means of processing client or event data, that tenant remains responsible for lawful collection, notice, consent where required, and handling data subject requests.

9. Availability and Support

Photom8 is operated with reasonable care, but no online service can be guaranteed to be uninterrupted, error free or immune from all security risks. Maintenance, provider outages, network issues or misuse may affect availability.

10. Limitation of Liability

To the maximum extent permitted by law, Photom8 and Boshoff Technology Service Solutions Pty Ltd are not liable for indirect, incidental, consequential or special damages, loss of profit, loss of revenue, loss of goodwill, or loss caused by third-party providers.

Nothing in these terms excludes liability that cannot lawfully be excluded under applicable law.

11. Changes to These Terms

Photom8 may update these terms from time to time. Material changes will be made available through the platform or public website. Continued use of Photom8 after updated terms become effective means you accept the updated terms.
